The most important issue during the establishment of the international tribunal is its legitimacy – Merezhko

Authoritative international organizations and representatives of different legal systems and different civilizations should be involved in its work.

At this point, create an international tribunal on the basis of the relevant UN Security Council resolutions, as was the case, for example, during the establishment of the International Tribunal for the Former Yugoslavia, are politically impossible, and other international legal ways of establishing a new tribunal must be sought. This was written by the chairman of the Verkhovna Rada Committee on Foreign Policy and Inter-Parliamentary Cooperation Oleksandr Merezhko in his article for ZN.UA.

And here it is appropriate to consider several possible legal constructions for the establishment of a tribunal against Russia:

1) the establishment of a tribunal on the basis of an international agreement with the widest possible range of parties;

2) the establishment of the tribunal on the basis of a resolution of the UN General Assembly or a decision of the Committee of Ministers of the Council of Europe.

“Other legal constructions are possible,” Merezhko said. To this end, it is advisable to create it with the participation of a reputable international organization, as well as to include representatives of different legal systems and different civilizations. That is, that the composition of the tribunal was as representative and not perceived as purely Western.
