The draft Law of Ukraine “On Circulation of civilian firearms” No. 5708 and related projects of amendments to the Criminal Code of Ukraine and the Code of Ukraine on Administrative Offenses No. 5709 propose to grant the right to carry traumatic weapons to all civilians. As he writes in his material for ZN.UA, “What to expect from the adoption of the draft law on weapons?» Deputy Minister of Internal Affairs of Ukraine Bohdan Drapyatyi, the logic of this concept is that traumatic weapons are quite sufficient for effective civilian self-defense.
According to the current legislation, the right to this type of weapon has a limited range of subjects: police officers, persons dismissed from police service, former police officers, employees of courts, law enforcement agencies and their close relatives, persons participating in criminal proceedings, people's deputies of Ukraine, members of public formations for the protection of public order and the state border, military personnel, individual civil servants and journalists.
“Firearms are rarely used in peacetime for the purpose of self-defense, because in such cases it is quite easy to allow excess the limits of necessary defense or extreme necessity, for which criminal liability is provided. On the other hand, a traumatic gun, which is an analogue of a rubber baton when properly used, does not pose such a high threat to human life as a combat gun, and therefore even its improper use or use exceeding the limits of self-defense has a significantly lower risk of mutilation or fatal consequences,” explains the proposal. changes to the legislation of the deputy head of the Ministry of Internal Affairs.
