Russian war crimes in Ukraine: what are the opportunities to bring the top leadership of the aggressor country to justice

The Coalition for Documenting War Crimes explained how Russians can be held accountable for war crimes committed by the occupiers in Ukraine after a full-scale invasion.

For 37 days now, Ukraine has been opposing the Russian invaders, who have been committing war crimes in our country since day one. The Coalition for Documenting War Crimes Ukraine.5am explained what opportunities there are to bring the top leadership of the Russian Federation to justice.

“Ukraine has already initiated the creation of a special judicial body – an intergovernmental tribunal. It plans to consider the crimes of aggression against Ukraine committed by the top political and military leadership of Russia and Belarus, “the coalition said.

Thus, the jurisdiction of the Special Tribunal for the Crime of Aggression against Ukraine will be given by the signatory states to the declaration on its establishment. It is now proposed that the tribunal be held in Kharkov.

Another possibility in the coalition was the International Criminal Court , which considers the crime of genocide, crimes against humanity and war crimes. The ISS includes 123 member countries. The countries concerned must extradite the defendants to the Court if they are in their territory. At the same time, the ISS has the right to issue an arrest warrant for senior management, including the head of state.

The phase of detention and transfer of defendants to the International Criminal Court can take years. However, if the suspects are hiding in Russia or Belarus, their actual participation in the trial and arrest are possible only if the political situation within these states changes.

Earlier it was reported that the International Criminal Court has launched a new stage of investigation into the situation in Ukraine. The team of the Office of the Prosecutor of the Ministry of Internal Affairs has already arrived in Ukraine to document and collect evidence of international crimes in our territory.
