Putin signed a law on non-compliance with ECtHR decisions

Russia has recognized the rule of Russian law over the decisions of the ECtHR. Judgments of the Strasbourg court issued after March 15 are not enforceable in Russia.

Russian President Vladimir Putin signed a law on non-compliance with resolutions European Court of Human Rights (ECtHR), rendered after March 15, 2022. On Saturday, June 11, the document was posted on the official portal of legal information, according to DW.

According to the new norm, payments of monetary compensation for the execution of ECtHR decisions made before March 15 can be made exclusively in rubles and only to accounts in Russian banks. The decisions of the Strasbourg court will no longer be a basis for reconsideration of decisions made by Russian courts.

Thus, the new law establishes the rule of Russian law over the decisions of the ECtHR, and the Criminal Procedure Code of the Russian Federation excludes the provision that ECtHR rulings are grounds for revocation of court decisions that have entered into force, as well as to resume criminal proceedings. or again, the circumstances that have opened up.

This bill was passed by the State Duma on June 7 in the second and third readings. The next day the document was approved by the Federation Council. The speaker of the lower house, Vyacheslav Volodin, said that the ECtHR had become “an instrument of political struggle” and that some of its decisions “directly contradicted the Constitution of the Russian Federation, our values ​​and traditions.” As an example, he cited the ECtHR's requirement to recognize same-sex marriages.

Kommersant previously quoted the Council of Europe's press service as saying that Russia owed about 74 million euros in fair compensation under the ECtHR's decisions, excluding a record 1.9 billion euros in favor of former shareholders of the Yukos oil concern. A total of 2,030 cases remain pending, of which 222 are pending (identifying structural and systemic problems that need to be addressed)./p>

After the Russian invasion of Ukraine, Russia was expelled from the Council of Europe .
