Mobilization in Ukraine — how the medical examination of conscripts takes place

Before being drafted into service, potential defenders must pass a medical examination – i.e. military – medical examination (VLE). Military Medical Commissions (MMC) are created to carry out this examination: they conduct an examination of conscripts and determine whether a person is suitable for military service. In the case of temporary ineligibility, partial ineligibility or complete ineligibility, the conscript receives a so-called white ticket, which is the basis for obtaining a deferment, writes the “Novoe vremya” newspaper.

The procedure for conducting a medical examination is specified in the Regulation on military medical examination in the Armed Forces of Ukraine.

The regulation on medical examination states that the examination takes into account the nature of the disease or physical defect, the degree of their development, functional disorders, as well as education, the specialty, the actual working capacity of the examined person and the requirements that the military service sets for the state of health in one or another type of the Armed Forces of Ukraine, branch of the military

In particular, when taking an examination, every conscript is examined :

  • a surgeon;
  • a therapist;
  • a neuropathologist;
  • a psychiatrist;
  • an ophthalmologist;
  • an otorhinolaryngologist;
  • a dentist;
  • a dermatologist;
  • if there are medical indications, doctors of other specialties.

Before the examination all conscripts should pass tests and carry out the necessary procedures:

  • general blood test;
  • general urine test;
  • serological blood test for: antibodies to human immunodeficiency virus (HIV), antigen to hepatitis B virus (HBsAg), antibodies to hepatitis C virus (anti-HCV), microprecipitation reaction with cardiolipin antigen (RW);
  • blood group and Rhesus status are determined;
  • fluorographic examination of chest organs is carried out;
  • prophylactic vaccinations in accordance with the calendar of preventive vaccinations;
  • electrocardiographic research;
  • persons who are over 40 years of age must have intraocular pressure measured, blood sugar tested.

The law establishes that VLC specialists must examine medical documents of conscripts from polyclinics and medical institutions by place of residence and stay on the register: medical card of an outpatient, extracts from a medical card from a district doctor, a district pediatrician, discharge epicrisis, dispensary examination and medical observation data, results of previous medical examinations, other documents characterizing the state of health . If necessary, they can order additional examinations or research.

After the examination is completed, the doctor writes a fitness conclusion (temporary unfitness or complete unfitness) in the conscript's record card ) to military service, the corresponding article of the Schedule of Diseases, the date of the examination and signs the conclusion indicating his surname and initials and seals it with his personal seal.

Based on the results of the medical examination, the doctor – a member of the draft commission makes a final decision on the fitness of the draftee based on his state of health and makes one of the decisions:

  • fit for military service according to the TDV columns “A” 1−11;
  • temporarily unfit for military service. Requires treatment (dynamic monitoring) for the period up to ________ (specify date);
  • subject to referral for additional medical examination and repeated medical examination;
  • unfit for military service in peacetime, limited fit in wartime;
  • unfit for military service with exclusion from military registration.

Decision on temporary unfitness< /strong> is accepted for the period necessary for the complete restoration of the functions of the body's organs and systems, but not more than one year. A new review should take place after the specified periodto resolve the issue of suitability for military service. If the disease is not cured, a final decision is made.

If the conscript does not agree with the decision of the VLK, the law provides for a procedure for challenging the conclusion in court proceedings or by filing complaints to the military medical commission of the highest level. Doubts about the correctness of the doctors' conclusion can be removed during a control examination in a military medical institution.

According to the regulatory document, the decision of the military medical commission of the regions can be appealed to the Central Military Medical Commission (CMC) or in court (subparagraph 2.4.10 of clause 2.4 of chapter 2 of section I of the Regulations).

In its in turn, decisions of the Central Committee of the Central Committee may be appealed in court (item 2.3.5, paragraph 2.3 of Chapter 2 of Section I of the Regulations). you need to:

  • submit an application for review of the commission's decision to the higher-level VLK;
  • the application must include all the documents provided by the VLK, whose decision is being appealed;
  • the reason for revising the decision should be indicated;
  • the results of previous medical examinations should also be provided.

In order to challenge the decision of the commission in court, you need to file a claim with the district administrative court of the conscript's choice. It can be the court at the place of his residence, or at the location of the VLK, the decision of which is appealed. ;

It is worth noting that the judicial procedure can be used immediately, without resorting to the pre-trial procedure.

The appeal of the decision of the VLK in court is carried out in accordance with the administrative procedure in accordance with the requirements of the Code of Administrative Procedure of Ukraine.< /p>
