Martial law in Ukraine: who has the right to go abroad

A number of citizens have the right to go abroad.

The right to travel abroad in martial law, which the Verkhovna Rada of Ukraine extended until May 25 , has a number of citizens who have the relevant documents . This is stated in the article of the Association of Lawyers of Ukraine for ZN.UA.

The right to travel abroad have:

  • Citizens who have a certificate of deferment of conscription and reserved for the period of mobilization in wartime by public authorities, enterprises, institutions and organizations.

Documents for confirmation : certificate of deferment of conscription ( reservation) + business trip documents.

  • Persons who have an opinion of the Military Medical Commission (VLK) on unfitness with exclusion from military registration.

Documents to confirm : Certificate of unfitness of the Military Medical Commission.

  • Citizens who support three or more children under the age of 18.

Documents for confirmation : Children's birth certificate (medical birth certificate), certificate of registration of marriage with the child's mother or court decision on divorce and determination of the child's place of residence, or a written agreement between the parents with whom the children will live and the participation of the other from parents in their upbringing, certificates of parents of large families.

  • Persons who independently raise a child (children) under the age of 18.

Proof documents : birth certificate of the child (ren) + death certificate of the child's mother/court decision on deprivation of the mother of parental rights/recognition of the missing person/court decision on divorce with determination of residence with the father.

  • Citizens dependent on a child with a disability under the age of 18 or an adult child with a disability of group I or II before reaching the age of 23.

Proof documents : certificate of birth of the child (children), certificate of registration of marriage with the mother of the child (children); Certificate confirming the appointment of social assistance/certificate of state social assistance to children with disabilities.

  • Adoptive parents, guardians, custodians, foster parents, foster parents with orphans or children deprived of parental care under the age of 18.

Proofs : a document confirming adoption, guardianship, custody (court decision, certificate of guardianship and custody, certificate).

  • Employed in the constant care of persons in need, in the absence of other persons who can provide such care. Employed in the constant care of a sick wife, child, as well as their parents or spouses who, according to the Medical and Social Expert Commission (MSEC) or the Medical Advisory Commission of a health care institution, need constant care.

< p> Proof documents : certificate of compensation for a person engaged in permanent care for persons in need (can be issued only at the registered place of residence), court decision, MSEC certificate.

  • Persons who have left for other countries for permanent residence.

Documents for confirmation : mark in the passport “Permanent residence” (stamp “Departure for permanent residence” ).

  • Applicants for professional higher and higher education, trainee assistants, graduate students and doctoral students studying abroad in full-time or dual forms of education (students, listeners).

Verification documents : Certificate of deferment issued by the military registration and enlistment office on temporary unfitness (from 1 to 6 months) for military service.

  • Persons with disabilities of groups I and II.

Documents to be confirmed : a certificate to the MSEC inspection report or a certificate confirming the relevant status; pension certificate or a certificate confirming the appointment of social assistance/certificate for benefits to persons with disabilities who are not entitled to a pension or social assistance.

  • Husband, adult son, husband of a daughter accompanying a person with disability of the I-II groups

Proofs : Documents proving family ties and disability.

  • Permanent caregiver I or group II and accompanies it.

Proof of proof : certificate, certificate of compensation (benefits, allowances) for care and documents proving disability.

  • An adult family member or guardian of a person with a disability declared incapacitated by the court and accompanying him/her. documents proving family ties and disability).

    • Citizens accompanying a person with a disability or other persons in need of permanent care and living in care facilities, including employees of such an institution.

    Verification documents : Order of the director of the care institution or the person replacing him on the departure of persons with disabilities or other persons in need of permanent care outside Ukraine and documents proving disability. At the rate of one person for 50 people with disabilities and other people in need of constant care.

    • Father (maybe together with mother), guardian, trustee, one or both foster parents, foster parents who accompany children with severe perinatal lesions of the nervous system, severe congenital malformations, rare orphan diseases, cancer, oncohematological diseases , cerebral palsy, severe mental disorders, type I diabetes mellitus (insulin-dependent), acute or chronic kidney disease grade IV, a child who has suffered a serious injury, needs an organ transplant, needs palliative care.

    Verification documents : A document issued by the medical advisory commission of the health care institution and a document confirming the family ties or authority of the person/certificate of state assistance for the child.

    • Persons accompanying children -orphans, children deprived of parental care, foster carers.

    Proof documents : Information about the person, written consent signed by the head or deputy head of the regional military administration (certified by the seal) on the permission to leave Ukraine for children, agreed with the National Social Service of Ukraine. Such approval may be provided by electronic means of communication. Invitation of institutions, organizations of different types and forms of ownership, which are authorized by the state of final stay of children or local governments of such state to take measures to receive and accompany children from other countries.

    • Persons from the Defense and Security Forces who suffered in connection with the armed aggression of the Russian Federation against Ukraine for medical treatment abroad. Departure of such persons is allowed accompanied by one of the family members of the first degree of kinship.

    Documents for confirmation : passport of a citizen of Ukraine for travel abroad; if available – a conclusion on the need to send a person for treatment abroad and a letter from the Ministry of Health agreeing with a foreign party on the list of persons whom health care institutions may accept for treatment abroad.

    • People's Deputies of Ukraine.

    Verification documents : Certificate of the People's Deputy of Ukraine.

    • Men who have a minor child (children) and a wife who is serving in the military (under contract, conscription during mobilization, etc.).

    Proof of proof : a document certifying the child's family ties and a document proving his wife's military service.

    • Employees of military administration bodies (administration bodies), military units (subdivisions), enterprises, institutions and organizations of the Ministry of Defense of Ukraine, the Armed Forces, the State Special Service, the SBU, the SZR, the National Guard, the State Tax Service, the National Police, NABU, DBR.

    Documents to prove : a document certifying the relevant place of work and a certificate of deferment of conscription.
