General mobilization: Who does not fall under the call during the war with Russia

Lawyers have prepared a list of categories who will not be drafted during the war.

After the full-scale Russian invasion of Ukraine, President Volodymyr Zelensky signed Decree №69/2022″ On General Mobilization “. The Ukrainian Bar Association clarified in the article who is not eligible for call-up during the war with Russia.

Who is not eligible for conscription?

According to Art. 23 of the Law “On mobilization training and mobilization” are not subject to conscription during mobilization:

1) reserved for the period of mobilization and for wartime by bodies, enterprises, institutions and organizations in the manner prescribed by the Cabinet of Ministers of Ukraine;

2) People's Deputies of Ukraine, deputies of the Verkhovna Rada of the Autonomous Republic of Crimea;

3) law enforcement officers or law enforcement agencies;

4) recognized as persons with disabilities or, in accordance with the conclusion of the military medical commission, temporarily unfit for military service due to their state of health for a period of up to six months (followed by the military medical commission);

5) women and men, guardians, trustees, foster parents, foster parents:

– dependent on three or more children under the age of 18;

– who independently raise a child (children) aged up to 18 years;

– bring up a child with disabilities under 18 years of age;

– maintain an adult child who is a person with a disability of group I or II;

– raising a child with serious illness;

– dependent on orphans or children under 18 years old, deprived of parental care; health care needs constant care;

– who have a wife (husband) from among persons with disabilities and/or one of their parents or parents of the wife (husband) from among persons with disabilities of group I or II.

Conscription for military service during mobilization is not subject to a special period:

1) applicants for professional higher and higher education, assistant trainees, graduate students and doctoral students studying full-time or dual forms of education;

2) scientific and scientific-pedagogical staff of higher and professional higher education, scientific institutions and organizations with academic degrees and/or scientific degrees, and pedagogical staff of general secondary education institutions;

3) women and men whose close relatives (husband, wife, son, daughter, father, mother, grandfather, grandmother or relative (full-fledged, inferior) brother or sister) died or went missing during an anti-terrorist operation from:

a) servicemen;

b) employees of enterprises, institutions, organizations involved in ensuring the anti-terrorist operation;

c) volunteer formations.

< p>Bill 7209 (which will become law after signing by the President) adds a new category of persons exempt from mobilization, namely women and men with a minor child (ren) and a husband (wife) serving in the military. That is, if you have a minor child, and your husband or wife is already serving in the military, you will no longer be mobilized.
