Compensation for destroyed property: instructions on how to get it

Owners of housing destroyed by the Russian war against Ukraine, may receive compensation for destroyed property. The algorithm of actions was outlined by the chief lawyer of the Izmail Legal Aid Bureau Maxim Dizanov.

Yes, the Procedure for determining the damage and losses caused to Ukraine was approved by the Cabinet of Ministers of March 20, 2022 №326. In addition, the Resolution of the Cabinet of Ministers of March 26, 2022 №380 approved the Procedure for submitting information on damaged and destroyed real estate.

The right to compensation will have:

  • owners of relevant real estate or construction customers in respect of construction projects;
  • investors in housing construction of facilities in respect of which the right to perform construction work has been obtained (including commissioned facilities in respect of which the right has not been issued property);
  • members of housing cooperatives who bought an apartment or other premises of the cooperative, but did not register ownership of it;
  • heirs of all the above categories.

Where to go

To report damaged and destroyed real estate, you must contact the center of administrative services or a notary, regardless of the place of residence or stay of an individual. This can be done both by the homeowner personally and by his representative on the basis of a notarized power of attorney.

If there are several owners of the same house, the message is submitted by each of them separately. If the owner owns several destroyed houses, the messages are submitted for each individual house.

What data should the message contain

  • Last name, first name, patronymic (if any) of the person.
  • Taxpayer's registration card registration number (in case of submission using the Action Portal mobile application) or series (if available) and passport number (for individuals who, due to their religious beliefs, refused to accept the taxpayer's registration card registration number and reported it to the relevant state body and have a mark in the passport) (in case of submission through the Action Portal), a unique entry number in the Unified State Demographic Register (if available).
  • Contact details (telephone number, e-mail address).
  • Real estate information: type of real estate; total area of ​​real estate. In the absence of accurate information on the total area, the length of real estate, the approximate area is indicated; address (location) of real estate; information that the real estate is a cultural heritage site (if necessary); other technical characteristics of real estate (if any); form of ownership of real estate; presence/absence of cultural heritage status.
  • Information on the number of persons living in real estate (for housing stock).
  • Information on damage or destruction of real estate (date and Approximate time of the event, description of the damage, including the area or length of the damaged real estate, photo, video recording (if available).
