Closing the case after the entry into force of the new law on decriminalization declared unconstitutional – the decision of the CCU

Such actions violate the presumption of innocence.

The Constitutional Court of Ukraine declared the norm of the Criminal Procedure Code unconstitutional , which provides for the closure of criminal proceedings in the event of entry into force of the law abolishing criminal liability for this act.

“On June 8, the Second Senate of the CCU decided on the constitutional complaint part one of Article 284 of the Criminal Procedure Code of Ukraine, according to which criminal proceedings are closed if “the law abolishing criminal liability for an act committed by a person” came into force, – the court said.

The author The petition stated that the closure of the criminal proceedings against the suspect violates the presumption of innocence, as it does not really prove the innocence of the accused.

Recall, the Verkhovna Rada proposes to speed up the exchange of accused or convicted prisoners of war in the bill to provide for the possibility of closing criminal proceedings, if the relevant authority a decision was made to transfer the suspect for exchange as a prisoner of war.
